it is the responsibility of the particular user to furnish trustworthy details
with regards to their personal information. Hence we urge all our customers to
provide and maintain accurate, updated and complete information about them all
the time.
2.DATA SECURITY:
Through
becoming a DigitalZine’s registered user, you further agree to:
a. Provide accurate, current and
complete information about you as may be prompted during the signup, login and
tracking form filling process at the time of registration (“Registration Data”)
b. Safeguard the security of your
password and identity
c. Maintain and promptly update the
registration data, and any other information that you may provide us from time
to time, for ensuring its accuracy, correctness and completeness
d. Accept all risks associated with
unauthorized access to the registration data and any other information that you
would provide us for availing our services
e. Notify us immediately about any
unauthorized usage of your account information or any other breach of security
by emailing us at info@digitalzine.in. Also, bear in mind that the
usage of our site’s services is void where prohibited
3.INFORMATION USAGE:
We
are not giving any form of confidential information to any of our clients.
Hence, as a registered user of our website, you possess the complete rights to
post the tracked content wherever required. Kindly note that the sole purpose
of the information given by us is providing awareness about the key content
updates of your competitor’s website. Hence we strongly recommend you to
refrain from using them for any illegal purposes.
4.SERVICE CONDITIONS:
DigitalZine
reserves the right to refuse from rendering the desired service to any user. Also,
note that we only compare the content of the page as of now and not other web
elements such as pdf files, documents, videos and images. The company at its
sole discretion can also change the price of its products or services if and
when required.
5.TERMS OF
USE:
All usage of our
exclusive content tracking service is governed by several terms and conditions.
DigitalZine will only track either the parent or the subdomain given by the
user. Further, the total number of domain links must not exceed 1,000 at any
point in time. Even, if the number of domain URLs is more than a thousand, we
will be able to track only the top-ranked 1000 pages of that particular domain.
Note that the
ranks of domains to be tracked are calculated based on an internal reference
count. The admin reserves the right to deactivate the domain at any instance. At
any point of time, if the customer wants to deactivate any domain, then he/she
has to contact the admin immediately.
As of now,
DigitalZine’s content monitoring service is available only for the pages
containing English language content. Suppose, if the domain that
you have added contains pages with other language contents, we will only
monitor the English content pages and will ignore the rest.
6.PAYMENTS
AND REFUNDS:
Whenever you
purchase a DigitalZine’s service that has a fee, you have an opportunity to
review and accept the fees that you will be charged, which is subject to change
from time to time. Whenever you add a service to your cart and proceed to the
payment, you authorize DigitalZine or its 3rd party payment processors such as
PayPal to charge your credit card/debit card for the full amount of the
applicable fees and all applicable taxes, and you represent and warrant that
you are authorized to use such payment instrument for the purpose of purchasing
such service.
Keep in mind
that if DigitalZine does not receive payment from your financial service
provider, you agree to pay all amounts due upon demand and acknowledge that we
may suspend your access to the services in the event such amounts are not
timely paid. All sales are final, and DigitalZine will not issue any refunds,
even in case of cancellation of an active subscription. Unless otherwise
stated, all fees are quoted in U.S. Dollars.
7.DISCLAIMER:
a. Modification:
DigitalZine, at
its sole discretion reserves the right to modify, replace or remove any
component of these Terms and Conditions at any time without prior notice.
b. Availability and function:
DigitalZine makes
no warranties, express or implied, as to the continued availability or function
of the Services or Content. DigitalZine is not responsible for any damages,
losses, or penalties resulting directly or indirectly from the degradation, unavailability
or lack of function of any Content or Services including but not limited to
server outages, technical glitches, data loss, intrusion, attack, update,
change, or error.
c. Release
from liability:
You release DigitalZine
from all liability associated with its services or the delivered content. In
addition, DigitalZine cannot be held liable for the availability, accuracy, the sentiment, decency, copyright compliance, or legality associated with any of
its services or content. Further, we are not liable or otherwise responsible
for losses, damages, penalties, legal actions or compliance errors associated
with the content or services or the use thereof.
d. Services
and content:
The Services and
Content is provided “as is,” and without a warranty or service level agreement
(“SLA”) of any kind. DigitalZine, its employees, affiliates, partners, managers
and agents make no warranties as to the safety or security of the services in
any given location or at any given time. Hence, DigitalZine does not warrant or
otherwise affirm that the services or content will exactly satisfy a user’s
requirements or be virus, error, and bug or defect-free.
e. 3rd
party services:
Certain components
of the Service may allow you to link to, integrate, or otherwise employ a third
party service, tool, product, website or other work. DigitalZine makes no warranties as to the
ability to integrate with, reliability, availability, functionality or other
facets of any 3rd party or integration point.
You understand and agree that any third party services are out of DigitalZine’s
control, and therefore we are not responsible or liable for any damages, penalties,
losses or other consequences associated with or due to the use of such 3rd
party services.
f. No
Waiver:
DigitalZine’s
failure to enforce any part of these Terms and Conditions shall not constitute
a waiver of its right to later enforce that or any other part of these terms of
service.
8.LEGAL CLAUSE:
These
Terms of Service shall be governed by and construed in accordance with the laws
of the local government authorities. You agree that any dispute arising from or
relating to the subject matter of all these Terms and Conditions shall be
governed by the exclusive jurisdiction of the respective courts of law.
